Fate of the criminal corpse investigated

ScienceDaily (Oct. 30, 2012) ? A new major research programme bringing University of Leicester academics in the School of Archaeology and Ancient History, and the School of Historical Studies together with expertise from the University of Hertfordshire, will examine the fate of the corpses of executed criminals.

Between 1752 and 1832 the bodies of executed murderers were legally denied burial in consecrated ground. Instead they were donated for anatomical dissection or 'hung in chains' (displayed in a gibbet). This new research programme brings together scholars from archaeology, medical and criminal history, folklore, literature and philosophy to explore the ways that the dead body of the criminal could still be powerful.

The 5-year project, supported by the Wellcome Trust with a grant for nearly a million pounds, uses the criminal corpse as a focal point from which the team can spin out to explore the many ways that human bodies were understood in the period between the seventeenth and the nineteenth centuries, and how attitudes that took shape at that time continue to affect our ambivalent feelings about how the dead should be treated.

"This is a great opportunity to study the history of the body at a fascinating time," said Professor Sarah Tarlow, an archaeologist at the University of Leicester and the leader of the team. "This is a key period in the development of modern medical knowledge, where the inside of the body was carefully explored and described by anatomists. At the same time it was generally believed that the touch of a hanged man's hand could cure cancers of the neck, and that suicides should be buried with a stake through their bodies.

"The emotional power of the dead body of the criminal was exploited by the State to enforce conformity with the law, they were exploited as sources of scientific or medical knowledge; they gave meaning to places in the landscape, for example, 'Gibbet Hills' and so on. At a popular level, their ghosts were believed to stalk the living and their bodies to be places of lurking malevolence which might threaten our comfortable lives -- as Frankenstein's monster did."

Professor Peter King, of the University of Leicester's Centre for English Local History, added: "We aim to look at the whole journey of the criminal body from sentencing to eventual disposal. Sentences passed were not always carried out; we want to find out what determined the eventual fate of the body. We need to locate the places where bodies were dissected and displayed -- both when they were hung in chains and when bodies or body parts were preserved as curios or as part of scientific collections."

Professor Owen Davies of the School of Humanities, University of Hertfordshire, explained how the project will also explore the use of criminal corpses in the medical and magical cultures of Europe. "One of the fascinating areas we are researching is how corpses that, in one sense, emanated evil, were also thought to have powerful beneficial healing properties for the living: in short the criminal body was life giving," he explains.

Philosopher Dr Floris Tomasini will work closely with the other team members to trace the history of some of our modern attitudes towards the dead body. "Why is there a public outcry when organs are retained by doctors after a death? Why do we attach so much importance to bringing the bodies of our war dead 'home'?" asks Dr Tomasini. "These are important questions in moral philosophy, but they have deep historical roots. I am excited to be working a new way with colleagues from other disciplines."

The team will be producing a number of academic publications but will also be setting up a website to host an online exhibition and keeping a blog of their findings and ideas as the project gets underway.

Ouya confirms game console will launch with Jelly Bean | Android ...

Android Central

The Android-powered Ouya?game console is still on schedule according to the developers' latest update, and they've confirmed that it will launch with Jelly Bean. It wouldn't be surprising to see Android 4.2 folded in before the planned launch early next year, even though that version was just unveiled a few days ago. Apparently the Ouya?folks?have been busy talking with developers over the last few months, which is key considering porting high-resolution games to the big screen and optimizing controls for Ouya's hardware will be key to its initial success.?

To that end, they've outlined a few tips for developers in advance of the December launch of the Ouya SDK. For example, the gamepad will have a single-finger touchpad and a button for system-wide access to shutting down or quitting a game, but none of the familiar buttons like back or menu. Apps should be ready to run at 720p, 1080p, and 1080i resolutions. Notifications aren't employed, and all games are effectively free (though laden with ads and in-app purchases as the game creators see fit). Finally, Ouya reminds app-makers that the system is built for Tegra, and that anyone itching to get their game optimized should test with an Nvidia-powered?Android tablet.?

As for the hardware, they've got the circuit boards printed, and are busy optimizing software and preparing dev kits for those that got in early.?

So, who backed Ouya? Any developers getting ready to make their games ready for the promising young system?

Brooklyn bishop rues failure to teach the faith, says Catholic vote for ...

CWN - October 30, 2012

In the latest in a series of diocesan newspaper columns on the upcoming election, Bishop Nicholas DiMarzio of Brooklyn lamented the Obama-Biden campaign?s emphasis on abortion and contraception.

?The reality is that we as a Church have failed to teach the truths of the faith in a clear and convincing manner to the Catholic faithful,? he wrote. ?However, the issue is not what we as a Church believe but whether or not we ought to be obligated to act in a manner contrary to our own belief.?

Bishop DiMarzio added:

It is inconceivable to me how Catholics could support such policies. Indeed, Roman Catholics who support abortion rights and vote for a candidate because of those policies, place him/herself outside of the life of the Church. In so doing, they also place themselves in moral danger.

Is it possible to vote for somebody despite their support for these policies? To my mind, it stretches the imagination, especially when there is another option. The dignity and sanctity of human life are the foundational values upon which all other policies are built. Concern for the poor, the stranger in our midst, they are all predicated upon our belief in the dignity and sanctity of human life.

Employee needs help: What can we do? ? Business Management ...

Q. Can we suggest psychiatric help for an employee we suspect may be having trouble with substance abuse? And can we require a random drug test?

A. Suggesting psychiatric help could be viewed as akin to requesting a medical examination, in which case it can be done only if it is for job-related reasons and is a business necessity. Suggesting psychiatric help could also support a claim that you perceived the employee to have a mental disability.

Refer the employee to your Employee Assistance Program (if you have one), or ask if you can provide any assistance. If the employee admits to a substance abuse problem, you could suggest a rehabilitation facility.

You can require a random drug test, but you should do so in the context of a drug testing policy. The policy should state the company?s prohibition on being under the influence of drugs or alcohol during work.

Daytrading, Stock Trading, Investing and Forex Trading ? Day ...

How does one make profits? The technique of selling and buying stocks over an especially brief time period can create big losses or profits for the day trader in just 2 minutes or hours. What's day-trading? Day-trading is an highly dodgy way of making an investment in the exchange. Statistics prove that 80-90% of all day traders make a loss at the end of each trading day. So while day-trading used to be a questionable sort of stockmarket dealing reserved generally to money firms pro traders and an elect group of non-public backers it's now also exceedingly common technique of trading among casual traders. However day-trading has become a skyrocketing popular type of trading lately due to the web and increased access to info. When We Will Not Accept A Loss It's the capability to accept the infrequent trading loss that may be a main factor in regardless of if you become a moneymaking trader .

I'm not saying trading losses are inspired, but how you sort out losses may noticeably influence your degree of trading success. Refusing to endure and correctly handle trades that do not work leads to trading mess ups. It's the lack of ability to deal with the unavoidable losing trade that causes traders to chop winning trades short, move stops in the middle of a trade, hang on to losing trades, average down, and fail to click the trigger on sound trade setups. This also gives you the chance to test the stocks pick programme first hand if you wish. This is simple enough to do and does not cost any investing cash to estimate how well its picks do as you can simply get the programme, receive a few picks, then sight follow their performances in the market.

These are less expensive stocks with a taste for going on really fast moneymaking jumps because they're easier influenced and influenced with less market action. The tricky part is finding these stocks and separating them from the rest which is the reason why some stocks pick programs were designed with the aim of only identifying these stocks, particularly. It?s rather common to see one of those stocks jump to double or treble in worth in an exceedingly short time.

Some of the systems may be able to overlook and monitor the stockmarket, or select the best pick of stock for trader . The most significant issue about trading methodology is that whether or not they are trusty? Is the data provided correct? How much to speculate in the system before we will be able to begin to earn in day-trading? In my private opinion, based primarily on my experience in securities dealing, I've been significantly profited from a specific trading program. You may either select the systems to frequently update the new stock statistical data, or use the ones that can investigate and prompt you the bullish stock pick or which is going to plunge. The better part is the completely refundable guarantee for any unacceptable. You can witness the results inside few days of use. The key here is to think first prior to jumping in. There'll be moments when you believe there is a great chance to make a trade only to realise that you are making for a problem. The sole way to achieve success in the stock exchange so far as daytrading is anxious is, to prophesy the stock patterns and try and make a capital on the short term market upward swing. You've got to observe the situation thoroughly before deciding for the very next step.

Oprah Smoking?

Have you seen this photo of Oprah smoking?

She sent it out by tweet to her gazillion followers, along with this statement:

And THAT?s a Wrap! Terrance Howard and me in our goodbye ?love scene?. Thanks Lee Daniels for the great experience. #theButler

Most of the media response to Oprah?s tweet focuses on the fact that in the new movie The Butler, Oprah will have a love scene with Terrance Howard.

Perhaps they all missed the latest news report about women and smoking?

A survey of nearly 1.2 million women in Britain showed that smoking throughout adulthood chopped on average 11 years off life span. Researchers followed these women for a dozen years, one of the most extensive studies into the connection between women and smoking ever conducted.

I know Oprah isn?t a smoker, never has been. She said that when she went to light up a cigarette for that scene she lit the wrong end.

But Oprah is a role-model to millions, particularly to the girls who attend her school. And this photo, this scene, sends the message that women smoking is sexy. A powerful subliminal message to impressionable young girls when that message is being delivered by a woman they respect.

I am, undoubtedly, at a raw place on this subject. Eleven years would put Sullivan, my grandson, in fourth grade. It would mean plenty of Christmases with Great-Grandma Shelby. It would mean that he would know her himself, and not just through story, or the few photos we have of him with her.

Mama is dying.

And doctors have been completely clear about the cause of her dying: Smoking. Lung cancer, spread to the brain, and now the liver.

Mama has been a life-long smoker.

It is, she told me, her shame.

She tried quitting, did quit, a time or two, but it was a demon that would dog her.

One of her doctors (all of whom have been everything you?d ever hope for in a medical professional) pulled me aside one day and said: ?Don?t beat yourself up for not getting your mama to quit smoking. There?s a reason they call it an addiction.?

I am hanging on to those words. They are a gift of grace as I watch Mama struggle with her own impending death.

There is absolutely nothing glamorous about dying from lung cancer.

Perhaps Ms. O ought to consider doing a photo op with Mama? Perhaps she can spend a day at Mama?s bedside, drying my mother?s tears when she weeps over the fact that she wants more time with her family.

Cigarettes robbed us of that, too. When you are not a smoker it is difficult to spend time with smokers. There is so much my mother would not do because those activities would require her to not smoke, or to limit her smoking. Going to the movies, attending basketball games, high school graduations, weekend getaways, visits to art galleries, and museums.

So it?s not just that smoking has shortened our mother?s life, although that is hard enough to deal with, it?s that what life she did have was always compromised by her smoking and our ability to tolerate that smoking.

Is there a photo op that shows the tension between a non-smoking daughter and a mother who is addicted?

The last time I begged my mother to quit smoking was about three years ago. ?Please, Mama, quit smoking,? I pleaded with her. Then, in desperation, I threatened her: ?If you die from smoking I am going to be so very angry with you.?

Mama not only continued to smoke these past few years she smoked more than ever.?It was her own desperation and disappointments that led her to that, but that?s a story for another day, a story I won?t write while my mother is living.

So here we are. Mama had several MRIs and a CT scan last week and the results were not good. There was a conference call with the family. Decisions about death and dying. Decisions I never ever wanted to be part of. In some ways I feel like I am serving on a death panel. ?Perhaps Ms. O could do a photo op depicting the scene in which adult kids have to struggle with how to help their mother die peacefully?

We will be calling in hospice this week.?And despite my threat to the contrary, I am surprisingly not at all angry about any of this.

I am just very, very sad.

Sad for Mama.?Sad for all the life she will miss out on. Sad for the life she?s already missed out on. Sad because it?s hard enough to die without feeling ashamed over the reason for that dying, and Mama does feel ashamed that she was so enslaved to smoking.?Finding the words to comfort a dying mother when she tells you that smoking is her shame is impossible.

Perhaps, Oprah also missed the recent studies showing that teen smoking is on the rise. That increase is tied directly to the glamorization of smoking in movies.

?Well over a dozen studies have shown that kids who watch movies with smoking are more likely to smoke,? said Dr. DiFranza,?a family health and community medicine specialist at the University of Massachusetts Medical School. ?Smoking in movies is more common now than it was in the 1950s and ?60s, whereas smoking among adults is half as common now as it was then. Movie producers are not reflecting real life.?

An estimated 4.5 million teens in the US smoke. An additional 3,000 teenagers under the age of 18 start smoking every single day.

Hollywood, who for a time joined in the anti-smoking campaigns of the 80s & 90s, has once again succumbed to the seduction of the myth that smoking is sexy.?And now Hollywood has co-opted one of America?s most-beloved and respected women ? the lovely Ms. O ? to sell that message to young, impressionable girls.

I, like millions of women, admire and respect Oprah, but it saddens me that she would allow herself to be filmed smoking, and then that she would glamorize that by tweeting such a photo of herself to millions of followers. It?s disappointing and disheartening.

Perhaps others can afford to light one up for R.J. Reynolds.

Me? I have a dying mother to attend to.

Rep: Lil Wayne didn't have seizure on plane

Robert Galbraith / REUTERS

Rapper Lil Wayne sings "Take Me Out To The Ball Game" at Game 6 of the playoff series between the St. Louis Cardinals and the San Francisco Giants on Oct. 21.

By Natalie Finn, E! Online

Lil Wayne isn't feeling too hot, but, according to his camp, he didn't have a seizure.?Let alone two seizures.?

Thoughts of Rick Ross couldn't help but pass through our heads when it was first reported that Wayne's flight had make an emergency landing in Texas last night because the rapper suffered a seizure onboard. His rep told E! News today, however, that the "Got Money" artist did make an unexpected stop in the Lone Star State, but it was to be treated for a severe migraine and dehydration.?

Lil Wayne announced break from rapping this summer

And now, his camp has informed MTV News that, contrary to a TMZ report, Wayne did not suffer another seizure today, once again aboard an airplane, and was rushed to the hospital upon arrival in Louisiana, where his Texas-to-L.A. flight was supposedly diverted.

According to Weezy's rep, reports of his condition have been exaggerated and the hip-hop star is resting at his home in Louisiana.

In the meantime, Lil Wayne's scheduled Saturda appearance to promote his clothing line TrukFit at the Jefferson Mall in Louisville, Ky., has been canceled.

Celebs are just like us--they have to pass through airport security! ?

May he feel better soon!

Canada Earthquake: 5.8 Magnitude Quake Hits British Columbia, Tsunami Warning For Alaska

VANCOUVER, British Columbia ? A magnitude 7.7 earthquake struck off the west coast of Canada, but there were no reports of major damage. Residents in parts of British Columbia were evacuated, but the province appeared to escape the biggest quake in Canada since 1949 largely unscathed.

The U.S. Geological Survey said the powerful temblor hit the Queen Charlotte Islands just after 8 p.m. local time Saturday at a depth of about 3 miles (5 kilometers) and was centered 96 miles (155 kilometers) south of Masset, British Columbia. It was felt across a wide area in British Columbia, both on its Pacific islands and on the mainland.

"It looks like the damage and the risk are at a very low level," said Shirley Bond, British Columbia's minister responsible for emergency management said. "We're certainly grateful."

The National Weather Service issued a tsunami warning for coastal areas of British Columbia, southern Alaska and Hawaii, but later canceled it for the first two and downgraded it to an advisory for Hawaii.

Gerard Fryer, a senior geologist with the Pacific Tsunami Warning Center, said the first waves hitting shore in Hawaii were smaller than expected.

Hawaii Gov. Neil Abercrombie said early Sunday that the Aloha State was lucky to avoid more severe surges after the powerful earthquake struck off the coast of Canada. Abercrombie said beaches and harbors are still closed statewide.

"We're very, very grateful that we can go home tonight counting our blessings," Abercrombie said.

The weather service also canceled a tsunami advisory for Oregon, leaving northern California as the only spot in North America still under a tsunami advisory.

Dennis Sinnott of the Canadian Institute of Ocean Science said a 69-centimeter (27 inch) wave was recorded off Langara Island on the northeast tip of Haida Gwaii, formerly called the Queen Charlotte Islands. The islands are home to about 5,000 people, many of them members of the Haida aboriginal group. Another 55 centimeter (21 inch) wave hit Winter Harbour on the northeast coast of Vancouver Island.

"It appears to be settling down," he said. "It does not mean we won't get another small wave coming through."

Canada's largest earthquake since 1700 was an 8.1 magnitude quake on August 22, 1949 off the coast of British Columbia, according to the Canadian government's Natural Resources website. It occurred on the Queen Charlotte Fault in what the department called Canada's equivalent of the San Andreas Fault ? the boundary between the Pacific and North American plates that runs underwater along the west coast of the Haida Gwaii.

In 1970 a 7.4 magnitude quake struck south of the Haida Gwaii.

The USGS said the temblor shook the waters around British Columbia and was followed by a 5.8 magnitude aftershock after several minutes. Several other aftershocks were reported.

The quake struck 25 miles (40 kilometers) south of Sandspit, British Columbia, on the Haida Gwaii archipelago. People in coastal areas were advised to move to higher ground.

Urs Thomas, operator of the Golden Spruce hotel in Port Clements said there was no warning before everything began moving inside and outside the hotel. He said it lasted about three minutes.

"It was a pretty good shock," Thomas, 59, said. "I looked at my boat outside. It was rocking. Everything was moving. My truck was moving."

After the initial jolt, Thomas began to check the hotel.

"The fixtures and everything were still swinging," he said. "I had some picture frames coming down."

Lenore Lawrence, a resident of Queen Charlotte City on the Haida Gwaii, said the quake was "definitely scary," adding she wondered if "this could be the big one." She said the shaking lasted more than a minute. While several things fell off her mantle and broke, she said damage in her home was minimal.

Many on the B.C. mainland said the same.

"I was sitting at my desk on my computer and everything just started to move. It was maybe 20 seconds," said Joan Girbav, manager of Pacific Inn in Prince Rupert, British Columbia. "It's very scary. I've lived here all my life and I've never felt that."

Residents rushed out of their homes in Tofino, British Columbia on Vancouver Island when the tsunami sirens sounded, but they were allowed to return about two hours after the quake.

In Hawaii, the tsunami warning spurred residents to stock up on essentials at gas stations and grocery stores and sent tourists in beachside hotels to higher floors in their buildings. Bus service into Waikiki was cut off an hour before the first waves, and police in downtown Honolulu shut down a Halloween block party. In Kauai, three schools used as evacuation centers quickly filled to capacity.

Fryer said the largest wave in the first 45 minutes of the tsunami was measured in Maui at more than 5 feet (1.5 meters), about 2 feet (60 centimeters) higher than normal sea levels. No major damage was reported.

In Alaska, the wave or surge was recorded at 4 inches (10 centimeters), much smaller than forecast, said Jeremy Zidek, a spokesman for the Alaska Department of Homeland Security and Emergency Management. The quake was felt in Craig and other southeast Alaska communities, but Zidek said there were no immediate reports of damage.

Vodafone UK making their '4G promise,' offering deals for early upgrades to 4G contracts

Android Central

Despite not having a licence at present, or any firm plans for a 4G LTE network, UK carrier Vodafone has come out fighting with their "4G Promise." Rival carrier, EE, is set to launch the UK's first 4G LTE network within days. Eager not to lose out too much to the new service, Vodafone is offering some pretty impressive deals for customers who upgrade to their 4G network when it eventually arrives.

The meat of the offer is pretty straight forward:

So if you’ve bought an iPhone 5 or Samsung Galaxy SIII (purchased after October 26th 2012) or Galaxy Note II, simply bring it back to one of our stores. Even if you’re still in contract, we’ll knock off 70% of your remaining contract charges, letting you upgrade your phone early and start a fresh contract.

70% is a huge amount to reduce an outstanding contract fee by, and shows that Vodafone is keen to not only retain their current customers who may think about switching, but attract those who are unable to get EE 4G LTE at the services launch. The deal only applies when taking out a new 4G contract in the future, and for devices bought between September 12 2012 and March 31 2013.

Strategies for Succeeding in the Cloud: What's Stopping You ...

image courtesy of camdiluv, Creative Commons license

Last week, Marc Baizman and I offered a workshop at the Massachusetts Nonprofit Network?s annual conference this week called ?Streamlining Nonprofit Organizations: It?s All About the Cloud.? Cloud computing allows you to access software from anywhere via the Internet, instead of your hard drive or local computer network (definition courtesy of TechSoup). Our presentation focuses on cloud adoption barriers, strategies for succeeding in the cloud, two nonprofit case studies, and a survey of cloud tools. In particular, we spent a lot of time talking about the five critical elements for success in the cloud and the nonprofit case studies. Why? Because success comes down to strategy: if you are prepared to succeed, you will.

In both nonprofit case studies about cloud adoption, the critical elements to success were internal collaboration and management support.?

According to TechSoup?s 2012 Global Cloud Computing report, citing survey data from 10,800 nonprofits and 88 countries, over 90% of the organizations surveyed are using cloud technology. The cloud-based services cited most frequently by respondents were email, social networking/Web 2.0, file storage/sharing, web conferencing, and office productivity. However, using cloud-based services is different from internalizing and optimizing them.

How many organizations have paid for a service, while only one staff person uses it, or no one does? Critical to internal optimization and success using the cloud are collaborative mindset and management support. Abandonment and disuse rates for cloud-based services will be high where the internal culture does not embrace trust, collaboration, and knowledge-sharing. I?ve written about the importance of connected culture for social media to really succeed, and the same connected and collaborative mindset is needed for an organization to really embrace cloud technology. These are not the only key factors to success in the cloud, however, which is why our presentation includes four other elements.

Five critical factors for succeeding in the cloud:

Strategy: Define what problems the cloud-based services should solve, make a requirements list, have a tech plan in place, and understand what cloud services your stakeholders will expect you to use based on industry standards.

Staffing: Ensure that responsibility for these services is in someone?s job description ? or else no one is responsible for its success. There?s a great chart in the TechSoup report that shows the number of staff who are using cloud-based services at organizations. (It is on slide 12 of the presentation.) The same is true for social media success: ideally, it is not your part-time volunteer, youngest member of your staff, or temporary staff person who is responsible for technology?or social media?at the organization.

Budgeting: While many cloud-based services are free, free services may not offer robust solutions to meet your needs. Create a tech plan budget to help you figure out where to start (including budgeting for tech planning). Marc offers a great piece of advice in terms of contracts: don?t get locked into a long-term contract! Sign a monthly contract if possible, since both nonprofit needs and software change rapidly.

Support: Think about what support the cloud-based service offers, and then think about your support needs for that service. Is it critical that your donor management service be up 24/7? If so, that?s a consideration. Take your needs into account when entering into both a service contract and pricing out services. Some services charge for each support call, others offer pricing for different types of support, and some offer little to no support at all.

Culture: The organizations that succeed in the cloud have a few cultural features in comment. They are comfortable with some type of experimentation, have executive support for the service, are collaborative in nature, and are not afraid of technology. Additionally, knowledge is shared about why the services are in place, and how to best use them across the organization.

In the presentation, Marc and I also offer a list of cloud tools from a number of categories, including social media measurement, internal communications, content curation, project management, file storage, donor management, and four additional categories. Check out the presentation for the list and some screen shots.

Resources

In addition, on slide 55, you?ll find a page of hyperlinked resources, including the TechSoup Global Cloud Survey 2012, NTEN?s State of the Nonprofit Cloud 2012, Idealware?s Field Guide to Software, and TechSoup?s sample budget program. If there are other great resources you know of, please share them in the comments below.

6 Ways to Strengthen the Bond Between Your Two Kids

Siblings are bound to each other by blood for life but their relationship may need a lot of nurturing and attention. As a parent, you may be worried about how your kids? relationship with each other may turn out to be when they get older. Put these worries at rest and take the following steps to strengthen the bond between your kids.

1. Plan family outings frequently

You can strengthen the bond between your two kids by spending more time as a family. Kids will learn the importance of being with each other only when they see the family bonding together. Whether it is a one-day picnic, an evening of playing board games or going bowling together, make sure you schedule outings and activities through which your kids get a chance to come closer to each other.

2. Schedule nights when your kids can do a mock sleepover

If your kids are really young, it may be the right time to etch the importance of sibling relationship on their impressionable minds. If they sleep in separate rooms, having a mock sleepover for them may be the perfect way to bond. Allow them to pitch a tent in the backyard, play board games all night long or play video games for a while. Recreate the kind of fun that they would have with their friends on a sleepover.

3. Get your kids to learn a new skill together

Kids love learning new things and if you are sending them to pick up new skills and hobbies after school, make sure they do it together. Having common interests will help them bond for life and they will never run out of things they can do together. Depending on their interests and aptitude, you can enroll them in classes that are about sports, art, baking or other hobby areas.

Energy drink caffeine levels often stray from labels: study

(Reuters) - Energy drinks do not always divulge how much caffeine they contain, and when an amount is listed on a label, it is not always accurate, Consumer Reports magazine has found.

According to a study released on Thursday by the magazine, 11 of the 27 top-selling energy drinks in the United States do not specify the amount of caffeine in their beverages.

Of the 16 drinks that did list a specific caffeine amount, five had more caffeine per serving than was listed and the average amount over was more than 20 percent.

The study comes fast on the heels of news that U.S. health regulators are investigating reports of five deaths that may be associated with Monster Beverage Corp's Monster Energy drink.

At the same time Monster, maker of the top-selling energy drink in the United States, is being sued by the family of a 14-year-old girl with a heart condition who died after drinking two Monster Energy drinks in a 24-hour period.

The lawsuit and reports of other deaths could escalate calls from critics including two U.S. senators and the New York attorney general about the safety of the beverages and the way they are marketed.

    CAFFEINE LEVEL NOT REQUIRED

Aside from companies not wanting to give away their secret recipes, Consumer Reports said there was another reason why some beverage labels do not reveal exact caffeine levels.

"There is no legal or commercial business requirement to do so," a Monster Beverage official told Consumer Reports. "And because our products are completely safe, and the actual numbers are not meaningful to most consumers."

Caffeine levels in the drinks tested ranged from about 6 milligrams per serving for 5-Hour Energy Decaf, made by Living Essentials, to 242 milligrams for 5-Hour Energy Extra Strength, the report found.

The drinks that Consumer Reports found that contained more caffeine than was listed on their labels included Arizona Energy, Clif Shot Turbo Energy Gel and Sambazon Organic Amazon Energy, as well as Dr Pepper Snapple Group Inc's Venom Energy and Nestle Jamba, sold by a partnership of Nestle and Jamba Inc.

One sample of its Archer Farms Energy Drink Juice Infused beverage had about 70 percent less caffeine than advertised, the report found. Archer Farms is the private label of retailer Target Corp.

None of the companies were immediately available to comment.

Associated Press Issues Misleading Defense of ... - Immigration Impact

Unlike lawyers and policymakers, journalists have an obligation to use language that ordinary people understand. Although the practice is generally helpful, it can sometimes result in oversimplification, or sacrificing accuracy for the sake of clarity. A perfect example is the memo issued by the Associated Press last week endorsing use of the term ?illegal immigrant.?

Calling an immigrant ?illegal? before the conclusion of immigration proceedings is like calling a criminal defendant ?guilty? before a jury has rendered a verdict.

At first glance, the memo?authored by Tom Kent, a high-ranking AP editor?appears driven by a dispassionate analysis of immigration law. To Kent, terms like ?unauthorized? and ?undocumented? obscure what he calls a ?legal reality,? i.e., that certain immigrants are present in the United States in violation of law. Without ?the fundamental right to be in the United States,? the memo says, ?their presence is illegal.?

In truth, immigration law is much more complicated than Kent suggests. Just as suspected criminals are presumed innocent until proven guilty (and thus referred to as ?alleged? or ?accused?), noncitizens charged with violating the immigration laws have a right to remain in the country until they receive a final order of removal. Last year, judges terminated more than 25,000 removal proceedings for lack of sufficient evidence, and granted relief from removal?such as asylum?in more than 30,000 cases. Thus, calling an immigrant ?illegal? before the conclusion of ?immigration proceedings is like calling a criminal defendant ?guilty? before a jury has rendered a verdict.

As importantly, many immigrants are authorized to remain and work in the United States?and are not considered ?unlawfully present? under the Immigration and Nationality Act (INA)?despite being in violation of the immigration laws. For example, immigrants with pending applications for asylum and permanent residence are eligible for employment authorization, as are those granted deferred action or a stay of removal. Indeed, if determining unlawful presence was as simple as Kent suggests, it?s doubtful that federal officials would have felt compelled to issue such extensive guidance on the subject.

(Side note: the memo also misleadingly instructs reporters to describe beneficiaries of the Deferred Action for Childhood Arrivals program as having ?temporary resident status,? a phrase the INA ?uses in reference to farmworkers who qualified under a 1986 legalization program, and which implies that deferred action is akin to legal immigration status.)

To the AP?s credit, its stylebook instructs reporters not to refer to ?illegals? or ?illegal aliens,? and permits them to use more neutral descriptors, such as ?living in the country without legal permission.? Kent?s memo also says certain noncitizens should not be described as ?illegal immigrants??such as youths brought to the country by their parents (because they did not consciously immigrate themselves) and those whose status is in current legal dispute?and encourages reporters to explain individual immigrants? stories rather than rely on labels.

In making these (sensible) concessions, however, the memo undermines its very defense of the term in question. If a reporter?s job is to report facts objectively, it is hard to see why one should rely on a term that is often legally inaccurate, may encourage readers to make sweeping generalizations, and can offend the dignity of those they describe.

Sarah Palin responds to ?shuck and jive? criticism

    Palin (Facebook)

Sarah Palin responded to the backlash triggered by the use of "shuck and jive" in her criticism of President Obama's handling of the attack in Benghazi, claiming the comment was not racially charged.

"For the record," Palin wrote on her Facebook page, "there was nothing remotely racist in my use of the phrase 'shuck and jive'--a phrase which many people have used, including Chris Matthews, Andrew Cuomo, and White House Press Secretary Jay Carney to name a few off the top of my head."

The former Alaskan governor and vice presidential candidate continued:

In fact, Andrew Cuomo also used the phrase in reference to Barack Obama, and the fact that Mr. Cuomo and I used the phrase in relation to President Obama signifies nothing out of the ordinary. I would have used the exact same expression if I had been writing about President Carter, whose foreign policy rivaled Obama's in its ineptitude, or about the Nixon administration, which was also famously rocked by a cover-up.

I've been known to use the phrase most often when chastising my daughter Piper to stop procrastinating and do her homework. As she is part Yup'ik Eskimo, I'm not sure if this term would be deemed offensive when it's directed at her or if it would be considered benign as in the case of Chris Matthews' use of it in reference to Rachel Maddow. Just to be careful, from now on I'll avoid using it with Piper, and I would appreciate it if the media refrained from using words and phrases like igloo, Eskimo Pie, and "when hell freezes over," as they might be considered offensive by my extended Alaska Native family.

On Wednesday, Chris Matthews slammed Palin on "Hardball," saying "shuck and jive" has "a particular ethnic connection."

"To throw it at the president as an ethnic shot is pretty blatant," Matthews said.

Palin dismissed the MSNBC host's rant:

The outrageously outraged reaction to this expression from perennial hypocrites like Chris Matthews has only made me laugh. Mr. Matthews, let me share with you my favorite Irish toast: "May we always be happy, and may our enemies always know it."

Rogue malware Android app creator Arrested

Malware and infection on any platform is a reality that most of us would rather not have to deal with nor accept. Any platform out there has the potential to pick up some sort of malicious things that will unknowingly cost you small amounts of money or big?chunks?of change. No matter what it sets a person back, it is depressing, irritating and frustrating.

Recently a 20-year-old?French man working out of his parent?s basement wrote a slew of malicious rogue Android apps and put them out onto the web. The infected and rewritten apps sent premium SMS messages unknowingly from your device. his work affected over 17,000 users and supposedly made him about half a million euros in the process since 2011. Which translates to $648,500 USD. The malware he unleashed didn?t just jack money from people?s pockets either. It also stole usernames and passwords for gaming and gambling sites.

He admitted to the crimes shortly after being arrested, but stated his actions weren?t those of greed. No, it was his love for computer technology and his ambition to be a software developer. Seems like a guy that is that smart could have done something to help the world and gain fame for greatness, not for harming the average consumer.

One down, 50 billion to go. This guy isn?t the only one out there doing things like this and he won?t be the last. One could easily say ?Good, I?m glad he got arrested. All those apps he wrote up though hit the?pirates. That will teach them to steal apps.? That very well might be true, but personally I am more?disappointed?that this guys intelligence was?squandered?with?malicious?intent. What I wouldn?t give to have that talent and make a?difference?for the good of the world and community.

What?s you take? How do you feel about malware and its use on Android, or any platform for that matter.

We Can't Predict Earthquakes—And We Shouldn't Scapegoat Scientists

Science fiction writer Robert Heinlein once wrote: "Throughout history, poverty is the normal condition of man. Advances which permit this norm to be exceeded?here and there, now and then?are the work of an extremely small minority, frequently despised, often condemned, and almost always opposed by all right-thinking people. Whenever this tiny minority is kept from creating, or (as sometimes happens) is driven out of a society, the people then slip back into abject poverty. This is known as ?bad luck.?"

These words were the first thing I thought of when I heard of the Italian decision convicting scientists of manslaughter. Their crime? Giving "incomplete, imprecise, and contradictory" information a few days before the town of L?Aquila was struck by an earthquake that killed 300-plus people.

According to prosecutors, the scientists failed to warn the little town of the danger of a large quake following small tremors that preceded it. But given that nobody knows how to predict earthquakes precisely, completely, and clearly, what other kind of information could the scientists have provided? ?Small tremors are no guarantee of a large quake to come. (CNN reports that at a meeting the week before the big quake, the Italian scientists called the risk "?unlikely,? but not impossible.").

The most that a scientist can say is that a particular area faces a higher or lower risk of large earthquakes over the coming century, but no one can say when an earthquake will occur. And many earthquake-causing faults still remain undiscovered, meaning that no prediction can be complete.

But there?s a bigger lesson here. The Italian justice system, already in bad odor after the Amanda Knox fiasco, has now made sure that no scientist in his or her right mind will ever give earthquake advice to Italians again if these convictions stand.?If I were an Italian earthquake researcher, I?d be giving serious contemplation to the prospect of relocating. (Four top disaster experts in Italy already have quit their posts in protest.) And if I were a researcher in some neighboring country, I might be reluctant to offer an opinion, lest some overreaching Italian prosecutor call Interpol for my arrest.

That?s too bad for Italy, which is one of the world?s major earthquake hotspots. Italian disaster officials, building-code writers, and insurance companies need the best earthquake advice they can get. But they won?t be getting it now. Instead, they?ll face a run of "bad luck."

I wish that I could write off this bizarre incident as the result of some risible quirk in the Italian national character. But, alas, I?m not sure that the problem is limited to Italy. The Italian prosecution, it seems to me, comes from a combination of scientific ignorance, a desire for security, and for revenge when things go wrong. None of those are limited to one country. (As far as the legality of putting scientists on trial, it?s doubtful a U.S. prosecutor could do it. Of course, I?d have said the same thing about Italy.)

If people understood the science?even at a high school Earth Science level?they?d understand that scientific predictions about earthquakes are at best educated guesses. If people understood that life is inherently risky, they?d realize that their desire for complete security can never be fully realized. And if people understood that the trauma of losing friends and family can give rise to an irrational urge to find someone to blame, they might resist the temptation to engage in the scapegoating that took place in Italy.

In more primitive times, of course, people responded to tragedies like earthquakes, plagues, and famines by assuming that someone had angered the gods or was practicing witchcraft. The offender was identified often by the sort of procedures parodied by Monty Python, and then hanged, burned, or thrown into a volcano. This didn?t do much to address the problem, but it let the survivors feel better, and let the authorities look like they?d done something about a problem that was in fact beyond their reach.

You would like to think that we?ve have moved beyond such primitive responses. But these responses stem from human nature and are only avoidable through education. The Italian convictions suggest that we?re not doing enough.

In debates and life, Romney likes the rules

WASHINGTON (AP) ? When it comes to debates, Mitt Romney loves the rules.

The eyes of millions of voters upon him, the Republican candidate is quick to poke holes in his rival's arguments. But he's just as ready to take the moderator to task when he believes the predetermined ground rules have been breached.

Expect more of the same Monday when he and President Barack Obama square off for the third and final time.

Romney bickered with moderator Jim Lehrer in the first presidential debate over whose turn it was to have the final say on taxes. "Jim, the president began this segment, so I think I get the last word," he said. He lodged a similar complaint in the second debate when denied one last chance to weigh in, prompting moderator Candy Crowley to interject that "it doesn't quite work like that."

"The last part, it's for the two of you to talk to one another, and it isn't quite as ordered as you think," she said.

It is that ordered for Romney, who seems at his best and most relaxed in settings with clearly defined parameters that many others experience as overly rigid or stilted. Romney's fondness for the rules mirrors other traits that have been frequent themes throughout his personal and professional life: organization, personal discipline and meticulous attention to detail.

For voters, it offers a window into the fastidiousness and precision he would likely bring with him to the Oval Office.

"He's highly analytical, highly linear in his thinking," said Doug Gross, who chaired Romney's 2008 campaign in Iowa. "When someone steps out of line and your logic is linear, that causes dissonance in your brain."

Romney's partiality to rules in the debate setting was on display throughout the Republican primary, where he resisted efforts by former House Speaker Newt Gingrich, R-Ga., to relax them. Gingrich, whose come-from-behind victory in South Carolina in January was fueled by robust debate performances, wanted audiences to be able to participate more freely in future debates.

Not so fast, said Romney, arguing that candidates seeking the nomination ought to be prepared for the much stricter rules imposed during general-election debates.

You might have thought Romney himself was the moderator in a debate last October when he cut off Texas Gov. Rick Perry to lay down the letter of the law.

"You get 30 seconds," Romney told his opponent. "The way the rules work here is that I get 60 seconds, and then you get 30 seconds to respond, right?"

It's not just during debates. The tendency to abide by rules permeates the way the former Massachusetts governor has carried himself as a candidate, a businessman and a patriarch.

On the campaign trail, Romney typically refuses to answer questions from the traveling band of reporters that constantly shadows him ? except for specially designated times.

"We have press avails and press conferences almost every day, and that's when I answer the questions," Romney said to reporters shouting out questions as he greeted voters in last November in Tampa, Fla.

As a businessman, Romney was known for his systematic, data-driven approach to evaluating risk. Former colleagues have described a man reluctant to entertain ethical gray areas, motivated by his sense that the best ideas thrive when the playing field is level.

"He has an intrinsic sense of fairness and playing by the rules," Gross said. "When he sees someone trying to sidestep or bend the rules, he thinks it's potentially disruptive to the entire process and the entire institution."

Such scrupulousness extends deeply into Romney's personal life, where he firmly adheres to the directives of his faith, abstaining from caffeine and alcohol and donating a substantial portion of his income to the Mormon Church.

Personal responsibility and discipline also seem to be values he expects those around him to uphold. A Vanity Fair profile of Romney in February detailed the strict rules that govern Romney road trips: No unscheduled bathroom breaks for the kids, except when the family stops for gas.

At their summer home in Wolfeboro, N.H., Romney's family holds an annual series of highly regimented games dubbed the "Romney Olympics." They partake in events like nail-hammering, where participants have to hammer a certain number of nails into a board. It's normally one of Romney's best events ? he doesn't tend to do as well in the more athletic competitions, like running ? but he lost a recent round because he put one of the nails in off-center.

In the Romney household, nails that aren't hammered in straight don't count.

Even the most mundane tasks aren't exempt from a wrong and right way of doing things. Asked about their spousal pet peeves in September on ABC's "Live! With Kelly and Michael," Ann Romney said her husband takes issue with the way she squeezes her toothpaste.

"That's right," he replied. "She doesn't go from the bottom and work up, and she leaves the top off."

Helping To Make The Proper Pension Decisions For Expat Life

Exploring your pension options when moving abroad

The amount of British people choosing to spend their retirements abroad is increasing year on year. People are escaping to places all across Europe and even further afield in a bid to find the sun and simply relax, but it?s a huge decision to pack up your entire life and start over again in a brand new country. Once you?ve made the choice to pack up your life and go overseas it?s down to you to make sure that all business you?ll be leaving behind is dealt with, and that means organising any pensions that you may have invested in over the years.

Which option is best for you?

While you could just leave your pension exactly where it is, heading abroad expands your options greatly and you?ll find that there are two routes that hold the most potential; SIPPS and QROPS. Both schemes have their advantages but by consulting with your financial adviser, you?ll soon see that they will benefit you greatly as a non-UK resident. There are a few factors that you should consider before making your decision as to which plan to invest in, so be sure that you always have the most up to date information at hand.

SIPPS, also known as Self Invested Personal Pensions, are the kind of scheme you want to go for if you like to take an active role in your finances and keep in touch with what your money is up to. You decide where your investments are made and will be responsible for making sure that the costs and taxes are met. Building a SIPP gives you access to a huge variety of different savings opportunities, and once you reach your mid-fifties, you?ll be able to pull out a lump sum of up to 25% as well as knowing that you?ve got a decent, regular income.

Will QROPS work better for you?

Qualifying Recognised Overseas Pension Schemes (also called QROPS) work in a different way to SIPPS. Even though you?re paying into a scheme that is essentially subject to British law, the investments that have been made on your behalf will eventually become subject to the tax laws of where you have chosen to move to. Again, you?re allowed to draw a large sum on retirement, but you should also be aware that the annual running costs of QROPS are significantly higher than the alternative.

No matter what scheme you select, just make sure to consult with a professional before you make a final judgment. Once you?ve made your choice, investigate all the options that are open to you and then you can begin to prepare for your future. Then all you need to do is make your move and settle in to your new place in the sun.
