Pentagon extends program to defend cyber networks (AP)

WASHINGTON ? As hackers and hostile nations launch increasingly sophisticated cyberattacks against U.S. defense contractors, the Pentagon is extending a pilot program to help protect its prime suppliers.

That program could possibly serve as a model for other government agencies. It is being evaluated by the Department of Homeland Security, as part of a potential effort to extend similar protections to power plants, the electric grid and other critical infrastructure.

Efforts to better harden the networks of defense contractors come as Pentagon analysts investigate a growing number of cases involving the mishandling or removal of classified data from military and corporate systems. Intrusions into defense networks are now close to 30 percent of the Pentagon's Cyber Crime Center's workload, according to senior defense officials. And they say it continues to increase.

The Pentagon's pilot program represents a key breakthrough in the Obama administration's push to make critical networks more secure by sharing intelligence with the private sector and helping companies better protect their systems. In many cases, particularly for defense contractors, the corporate systems carry data tied to sensitive U.S. government programs and weapons.

So far, the trial program involves at least 20 defense companies. It will be extended through mid-November, amid ongoing discussions about how to expand it to more companies and subcontractors.

"The results this far are very promising," said William Lynn, the deputy secretary of defense who launched the program in May.

Lynn, who has just left office, said the government should move as quickly as possible to expand the protections to other vital sectors.

A senior DHS official said no decisions have been made, but any effort to extend the program ? including to critical infrastructure ? faces a number of challenges.

The official, who spoke on condition of anonymity because the program review is ongoing, said it would be helpful if Congress would pass legislation that explicitly says DHS is responsible for helping private sector companies protect themselves against cyberattack. Also, the legislation should say that companies can be protected from certain privacy and other laws in order to share information with the government for cybersecurity purposes, the official said.

Senior U.S. leaders have been blunt about the escalating dangers of a cyberattack, and have struggled to improve the security of federal networks while also encouraging the public and corporate America to do the same.

"Cyber actually can bring us to our knees," said Adm. Mike Mullen, chairman of the Joint Chiefs of Staff, adding that at some point the Pentagon may need to develop some type of governing structure similar to how the U.S. and allies monitor and limit nuclear weapons.

Data compiled by the Defense Cyber Crime Center shows that the number of investigations handled by analysts there has more than tripled over the past 10 years. And a growing number of them involve defense contractors ? including those participating in the pilot program.

Housed near Fort Meade, Md., the so-called DC3 employs about 100 digital examiners who sift through millions of bytes of data in the digital forensics lab. Stacks of hard drives line the shelves, and clear plastic evidence bags are filled with a vast expanse of computer technology ? from cell phones and tiny flash drives to iPads, Wii consoles and Nintendo games.

The analysts dissect intrusions, malware and other attacks that have breached or tried to burrow into the defense contractors' computer systems. And while those investigations are just a small fraction of the lab's work, the number has grown steadily over the past three years.

The caseload includes about 100 in the past year that involve the defense industrial base. Much of the center's work is for criminal cases for the military's investigative branches ? including the Army and Navy criminal investigative services and the Air Force Office of Special Investigations.

Cybersecurity expert James Lewis said there will be some tough hurdles in any effort to expand the pilot program to more military contractors or through DHS to other critical infrastructure companies. But he said it can be done.

The Pentagon has multi-million dollar contracts with companies, making it easier to build on those relationships and, if needed, link cyber threat cooperation to future contracts, said Lewis, who is with the Center for Strategic and International Studies.

DHS, however, doesn't have that type of contracting relationship with electric companies, power generation plants, financial firms or other critical corporations that run vital infrastructure. And the agency would probably need additional congressional authorities to set up a program similar to the Defense Department pilot.

A 4-Ingredient Meatless Monday | No Excuses BBQ

It?s time once again for the 4-Ingredient Challenge, and once again it comes with several disclaimers. First, the title might include the words ?Meatless Monday?, but that is only because it is being posted on Monday. I plan on having an all-meat dinner tonight to make up for what I did to us on Sunday. Second, I wasn?t responsible for the protein for this challenge in spite of what Larry from The BBQ Grail will tell you. And last, I don?t even intend to do this again, nor do I endorse any of you trying this one at home.

The four ingredients this month? Tofu, potatoes, peas (of any sort), and melon. Originally the melon was cheese, until it was pointed out that cheese is not a fruit (although my wife would have you believe that it is). As such, it is my understanding that a few of this month?s participants actually got this out of the way early in the month before the discrepancy was pointed out. Personally, I believe that they chose to ignore the melons. I fully expect to see mashed potatoes, tofu, and peas with a cheese topping baked into it?

At any rate, I finally came up with a concept after racking my brain for a couple of weeks (and spending an inordinate amount of time looking at vegetarian sites on the Internet). It involved cooking potatoes, tofu, and watermelon cubes on the BS Keg.

The taters were trashbag style using the same spices as the last few cooks. What can I say, I?m in a rut. While I was at it, I cut the tofu into cubes and dusted it with some Rub Company Original recipe, stabbed it with wooden skewers, and put it on the grill with some skewered watermelon. Oh, and I also prepared some tofu just for The BBQ Grail.

I don?t care for peas, but do like fresh snow peas, so they were chopped and mixed with the greens that formed the base of the salad that resulted from all this nonsense. The dressing was a mix of EVOO and balsamic vinegar, and some chopped cilantro was added to the salad mix to give it some zing. The grilled ingredients were stacked on top, and joined by some feta cheese.

The resulting salad wasn?t actually that bad, although the taters didn?t work very well with it (even though they were tasty by themselves). The tofu? Well, like white rice, it tasted like what was put on it. SWMBO was on me for not marinating the tofu, but that was part of my plan. I don?t want to have her think I might be interested in fixing it again?

As for the carved tofu, it was brushed with BBQ sauce in order to insure it was truly FauxQue. Larry, this photo is for you:

Eni, Total resume oil production in Libya

(AP) ? Italian energy giant Eni said Monday it has resumed oil production in Libya after months of interruption for the civil war, tapping 15 wells and producing some 31,900 barrels of oil per day. French energy company Total said it restarted some production last week.

Libya's economic future could hinge on the performance of its lucrative oil and gas sectors, whose production ground to a halt during this year's insurgency against Libyan strongman Moammar Gadhafi.

Libya sits atop Africa's largest proven reserves of conventional crude, and with a population of only 6 million, raked in $40 billion last year from oil and gas exports. Still, experts say it could take about a year or more to get Libya back to its pre-war production of 1.6 million barrels a day.

Eni's revived production operations have focused on 15 wells at the Abu-Attifel field some 185 miles (300 kilometers) south of the eastern city of Benghazi, and are being conducted by Mellitah Oil & Gas, a partnership between Eni and Libya's state-run National Oil Corp.

Eni said in a statement that other wells will be reactivated "in the coming days" to reach the "required volumes to fill the pipeline" between the Abu-Attifel field and the Zuetina port on the Mediterranean.

French company Total said Monday that it resumed production on Sept. 23 in partnership with Libya's state-run oil company and a German company at an offshore well called Al Jurs. Production is slowly ramping up but will eventually be 40,000 barrels a day, according to Florent Segura, a Total spokesman.

Eni's statement was the first from an oil company saying production had resumed since the civil war. Mahmoud Jibril, the Libyan acting prime minister, had said Sept. 11 that oil production had resumed at one unspecified oil field in Libya's east, but he gave no details.

The Abu-Attifel field was the first "giant" oil field discovered by Eni in the 1960s.

Before Libya's social uprising in mid-February morphed into a full-scale civil war, Eni was producing 273,000 barrels of oil equivalent per day in Libya. It was the largest foreign producer in Libya before the civil war broke out, and its operations, mirroring Libya's oil sector in general, ground to a halt because of the fighting.

Eni CEO Paolo Scaroni visited Tripoli earlier this month to lay the groundwork for relaunching gas exports to Italy via the Greenstream pipeline, which can carry roughly 10 billion cubic meters of natural gas per year. It hasn't been operational since late February.

Scaroni has set Oct. 15 as an admittedly optimistic deadline to restart the gas flow.

Officials from the Libyan transitional government have said the new government would respect past contracts and not rush into any new deals.

Spain's Repsol YPF said Monday it hasn't restarted production yet at the fields it operated in Libya and doesn't have guidance on when it could resume. No Repsol employees have been sent yet to the firm's facilities in Libya, but the company is using Libyans and contractors to assess its infrastructure there.

"Repsol continues to closely monitor events in Libya," said company spokesman Kristian Rix.

Eni has been active in Libya, Italy's former colonial ruler, since 1959 and is the largest foreign player there in terms of hydrocarbon production.

Scaroni was the first foreign CEO to sign an agreement with the then-rebels to restart the Greenstream pipeline and asses the oil infrastructure in Libya, and his visit to Tripoli marked the first by a foreign company chief.

How Mobile Phones Work ? BuildMobile

Mobile phones have become a ubiquitous part of modern life. It is estimated that there are over five billion cell phones currently in use, covering a large portion of the world?s population. However, most people who use mobile phones do not understand how they work. This article demonstrates how a combination of sophisticated radio technology and computer security create the mobile phone systems many take for granted.

?The first thing to understand is that underneath the long-distance capabilities, elaborate touch interfaces, and other bells and whistles, modern mobile phones are essentially nothing more than two-way radios. Therefore, to understand how mobile phones work, one must first understand how radio works.?

A radio antenna is a device which turns radio waves into electric currents that can then be processed into sound by a radio receiver. Additionally, it can do the opposite, and convert existing electronic audio signals into transmitted radio waves that other antennas can receive. When a mobile phone transmits audio, it applies an oscillating electric current to the mobile phone antenna. The mobile phone antenna then emits corresponding electromagnetic waves, which are also known as radio waves. To receive calls, the mobile phone antenna intercepts an electromagnetic wave of a particular frequency. Its terminal then receives a minuscule amount of voltage, which is amplified and converted to sound by other components.

Through the process explained above, mobile phone antennas transmit signals to radio towers and receive signals back simultaneously. However, the technology that enabled such sophisticated use of radio signals was developed gradually over many decades.

The closest predecessors of mobile phones were the radios installed in truckers? vehicles that allowed them to communicate while on the road. Because the radios were so large and heavy, they were impractical for consumer use. These mobile communication systems tended to use one central antenna in each city they serviced. Only a few dozen channels were available on each tower. Therefore, the system wouldn?t work if too many people were trying to use it at once. Also, because the system was only half-duplex, only one party could talk at any given time. This need to be brief and one-way led to some interesting lingo, but it wasn?t very convenient for the average person to use.

Modern mobile phones, in contrast to the portable radio communication systems of old, use cellular networks. Cellular networks are also radio networks, but they are far more sophisticated than the simple local towers that powered old radio communication systems. In a cellular network, the towers are distributed over portions of land called cells. These cells are usually hexagonal in shape, but they can also be square or circular. Each cell of land contains at least one radio tower.?

Each cell is also assigned a number of frequencies which correspond to radio base stations. Other cells can use the same frequencies as long as they are not adjacent. In other words, use of the same frequency must be spaced at least one cell apart. This is done to avoid interference between calls whose signals use the same frequency. This ability to reuse frequencies is the key to the cellular network?s power; far more people can make calls across the network, and over longer distances. Whereas single-transmitter systems cannot reuse the same frequency, cellular networks can use the same frequency in multiple areas for different transmissions, as long as the transmissions are not close enough to cause interference. Because of the cellular approach, conversations can be carried across cells, making it easy to talk to people who are across the country. Additionally, these systems are half-duplex, which means the phone sends and receives a signal at the same time. This makes it possible for people to talk and listen at the same time, and thus to carry on a conversation in the manner to which they are accustomed.

The concept of a cellular network is not limited to mobile phones, but mobile phone networks are an especially sophisticated kind of cellular network. Cellular transmitters and handsets can change frequency under guidance of automated computer systems that find the optimal ranges to avoid interference. They generally have 800 different frequencies available for each cluster of adjacent cells. Because of the nature of wavelengths, lower-frequency waves travel longer without being broken up by atmospheric noise. This principle holds true for mobile phone signals. Lower-frequency clusters are better for long distances, whereas higher-frequency are better for dense areas. Therefore mobile phone signals rural areas tend to use relatively low frequencies, and in urban areas they use high frequencies.?

In cities each cell site typically covers half a mile. In rural areas, they tend to cover about five miles. However, this is not the true limit of modern mobile phone reception. Given circumstances in which there is no interference or blockage, it is sometimes possible to receive a signal from a cell site 25 miles away. Mobile phones also tend to use low power transmitters to avoid interference between calls in compactly arranged cells. Each cell site is connected to telephone switches, which allows for calls to be made from cell phones to the public telephone network.

Many different standards have been established for how mobile phone networks are supposed to communicate and coexist with each other. Currently, the most popular mobile phone communication standards are GSM and CDMA. A new high-speed standard called LTE is being introduced in populous areas.

To counteract unauthorized use of their networks, mobile phone providers have introduced security measures that do not allow a phone to receive and transmit calls without certain valid data. This data is usually stored on small microchips called Subscriber Identity Modules, or SIM cards for short. The data they carry is known as the service-subscriber key. The technical name for this data is the International Mobile Subscriber Identity. This is used to gather information about the mobile country code, the mobile network code, and the mobile station identification number of the phone. It also carries an authentication key. SIM cards are most commonly used in phones that are intended for GSM networks. Many phones built for CDMA networks do not use removable cards, and instead embed the security information permanently in memory. However, ?world? phones that can handle both communication protocols include SIM cards.

By sending and receiving radio signals through a vast interconnected network, mobile phones can make calls almost anywhere in developed countries, over distances of thousands of miles. Mobile phones are a wonder of modern technology.

Financial Destabilization, Credit Default Swaps (CDS) and the ...

In July-September 2011 the stock markets were again shaken at international level. The crisis has become deeper in the EU, particularly with respect to debts. The CADTM interviewed Eric Toussaint about various facets of this new stage in the crisis.

CADTM: You haven?t talked about Credit Default Swaps (CDSs) yet.

Eric Toussaint: CDSs are a derivative financial product which is not submitted to any form of public control. They were created in the first half of the 1990s in the middle of the era of deregulation. Credit Default Swap literally means permutation of unpaid debts. Normally, it should allow the holder of a loan to obtain compensation from the CDS seller in the case of default by the bond-issuer, whether a government or a private company. I use the conditional for two main reasons. Firstly, a CDS can be bought as protection against the risk of non repayment of a bond that the buyer does not have. This is the same as taking out insurance for the house next door, hoping that it will catch fire so that one can get the money. Secondly, CDS sellers do not begin by banking enough funds to indemnify victims of defaults. If a whole lot of private companies having issued bonds should go bankrupt, or if a major lender State should default on payments, it is quite certain that CDS sellers would be incapable of indemnifying as promised. In 2008, the collapse of the North-American company AIG, the biggest international insurance company (which was actually nationalized by Bush to avoid the consequences of bankruptcy) and that of Lehman Brothers were directly linked to the CDS market. AIG and Lehman had both been very active in this sector.

The CDS enables all sorts of manipulations. I had the opportunity to observe closely an attempt at manipulation when I was a member of the audit commission for the internal and external debts set up by the government of Ecuador in 2007, which delivered its report in September 2008. While we were auditing the Ecuadorian debt and President Rafael Correa was threatening to stop paying the illegitimate part of the debt to the international money markets, a private North-American company contacted the Ecuadorian government with a most edifying proposal. The company suggested that President Correa should let it be known that he was going to suspend payments just before the next due-date three weeks later. This would enable the company to sell CDSs for a value they had calculated at USD 300 million. The final outcome was supposed to be as follows: in reality, Ecuador would pay what it owed as usual. This would mean that the company would not need to indemnify the CDS holders and it would give half the proceeds to the Ecuadorian government. The company claimed that this operation was completely free of any risk of prosecution as it would be an over-the-counter transaction outside US government control. It claimed to have already carried out similar transactions on several occasions. In the end, the Ecuadorian government refused the offer, opting for another strategy which produced good results. The point about this true-life story is that it illustrates that issuers and buyers of CDSs can carry out all sorts of manipulations. Let us not forget that right up until the AIG disaster and the collapse of Lehman Brothers, the IMF, the US Federal Reserve and the ECB repeatedly claimed that CDSs were a new product that offered excellent guarantees against risks (see the box on CDSs). Since then, their discourse has changed, but nothing, absolutely nothing, has been done to regulate the CDS market. Meanwhile, in view of the size of the phenomenon, CDSs constitute a huge time-bomb hanging over the international finance system. The fact is that CDS should be outlawed.

In 2007 when the crisis had already broken out in the USA and was spreading to the EU, Alan Greenspan, former Director of the US Federal Reserve, wrote: "A recent financial innovation of major importance has been the credit default swap. The CDS, as it is called, is a derivative that transfers the credit risk, usually of a debt instrument, to a third party, at a price. Being able to profit from the loan transaction but transfer credit risk is a boon to banks and other financial intermediaries, which, in order to make an adequate rate of return on equity, have to heavily leverage their balance sheets by accepting deposit obligations and/or incurring debt. Most of the time, such institutions lend money and prosper. But in periods of adversity, they typically run into bad-debt problems, which in the past had forced them to sharply curtail lending. This in turn undermined economic activity more generally. A market vehicle for transferring risk away from these highly leveraged loan originators can be critical for economic stability, especially in a global environment. In response to this need, the CDS was invented and took the market by storm. The Bank for International Settlements tabulated a world-wide notional value of more than $20 trillion equivalent in credit default swaps in mid-2006, up from $6 trillion at the end of 2004. The buffering power of these instruments was vividly demonstrated between 1998 and 2001, when CDSs were used to spread the risk of $1 trillion in loans to rapidly expanding telecommunications networks. Though a large proportion of these ventures defaulted in the tech bust, not a single major lending institution ran into trouble as a consequence. The losses were ultimately borne by highly capitalized institutions?insurers, pension funds, and the like?that had been the major suppliers of the credit default protection. They were well able to absorb the hit. Thus there was no repetition of the cascading defaults of an earlier era."[3]

In 2007 the IMF issued the following declaration referring to the health of the United States and particularly CDSs, labelled new risk-transfer markets: ?Although complacency would be misplaced, it would appear that innovation has supported financial system soundness. New risk transfer markets have facilitated the dispersion of credit risk from a core where moral hazard is concentrated to a periphery where market discipline is the chief restraint on risk-taking. (?)Although cycles of excess and panic have not disappeared ? the subprime boom-bust being but the latest example ? markets have shown that they can and do self-correct.? (IMF, 2007 Consultations Report , article 4 with the United States)[4].

Clearly, certain supposedly reputable banks are still covering themselves against defaults through CDSs. Thus the Deutsche Bank announced at the end of July 2011 that it had reduced its exposure regarding the Italian debt by 88%. The principal German lender claims to have reduced its exposure in Italy from EUR 8 billion to EUR 997 million. According to the Financial Times, the Deutsche Bank achieved this not by selling over 7 billion euros? worth of Italian bonds, but by a stroke of book-keeping wizardry, buying up CDSs to hedge its investments against possible default on the part of Italy.[5]

On another level, hedge funds, particularly active on the OTC and CDS markets, are worried at the perspective of the Greek debt being partly written off. They are wondering whether they will retain enough street cred to continue selling CDSs once they have failed to indemnify CDS holders of the Greek debt.[6]

CADTM: How much responsibility do rating agencies bear for the crisis?

Eric Toussaint: The North-American Standard & Poor?s and Moody?s and the Franco-American Fitch are the three private agencies which rule the roost regarding credit ratings and the credibility of bond issuers, whether they be State or corporate.[7] They have existed for almost a century but it was not until the 1970s-1980s, with the financialization of the economy, that their business took a sudden leap. However they are constantly in a situation of conflict of interests. Until the 1970s, it was the prospective buyers of bonds issued by the State and by companies who paid rating agencies for their advice on the quality of the issuers. Since then, the situation has been completely reversed: now it is the issuers of bonds who pay the agencies to rate them. What motivates the government and the companies is of course to get good ratings so that they can pay the lowest possible interest rates to those who buy their bonds. Let us recall that until the eve of the collapse of Enron in 2001, highly paid rating agencies attributed top marks to the power supplier. Again, in 2008, it was the same story with the investment banks, Merril Lynch and Lehman Brothers. And again with Greece in 2009-early 2010. These are ample demonstrations of the harm they do. They should be sued for the damage caused by the results of the ratings they hand out. Risk assessment is a task which should only be entrusted to public bodies.

Rob Tison?s Reflections on ALS and Fatherhood

Fatherhood and ALS are far from the ideal situation. But, of course none of us chooses to be diagnosed with ALS, and all of us have loved ones. I am the father of two wonderful children, a 15 year old son and an 11 year old daughter. It is extremely difficult to realize that ALS will result in a short life for me, and leave my two children without a father (and my wife without a husband). It is extremely difficult to imagine not being there for graduations from high school & college, marriages, or the births of grandchildren.

Always trying to be an optimist, I realize the cloud of ALS has a silver lining. In my pre-ALS days, I was a workaholic. I?ve always enjoyed working, took work seriously and perhaps too seriously. I have always thought that anything worth doing was worth doing well.

My kids suffered?

ALS has forced me to practice carpe diem, or seize the day.

My kids are a great help. My relationship with them is stronger than ever. They have learned to appreciate what I could do or still can do. And, they are eager to help me as I become more reliant on them. ALS may take my children?s father from them, but will leave them as stronger, more caring, more independent children who take few things for granted and make the most of every day?..

Euro associations aim to end August exhibitions

LIMASSOL, Cyprus - UEFA says Europe's national soccer associations want to have only double-headers for international matches and avoid matches in August.

A two-day meeting of its 53 member FAs ended Thursday in Limassol, Cyprus. Members expressed a desire for a calendar that only features double-headers and scraps the exhibition matches before the season.

UEFA President Michel Platini says the calendar remains a top priority for UEFA, which will decide on the best option before making a recommendation to FIFA. The international governing body has the final say on the calendar.

European clubs have pressed UEFA and FIFA to drop August internationals, describing them as "nonsense" matches which disrupt preparations for their season.

BY THE PRESIDENT OF THE PHILIPPINES

EXECUTIVE ORDER NO. 56

AUTHORIZING THE SECRETARY OF FINANCE TO ORDER THE OPENING OF INCOME TAX RETURNS OF SPECIFIC TAXPAYERS FOR INSPECTION TO EFFECTIVELY IMPLEMENT REPUBLIC ACT NUMBER 10021, OTHERWISE KNOWN AS THE ?EXCHANGE OF INFORMATION ON TAX MATTERS ACT OF 2009?

WHEREAS,?it is declared as the policy of the State to promote and pursue a tax environment that contributes in sustaining favorable international investment climate and instills confidence in the adequacy and capacity of the country?s tax administration to comply with its commitments under existing international conventions or agreements on tax matters;

WHEREAS,?Republic Act (RA) No. 10021. otherwise known as the ?Exchange of Information on Tax Matters Act of 2009? was enacted on 8 March 2010 in order for the government to comply with or commit to the internationally-agreed tax standards required for the exchange of tax information with its tax treaty partners to help combat international tax evasion and avoidance and to help address tax concerns that affect international trade and investment;

WHEREAS,?Section 4 of RA No. 10021 amended Section 71 of RA No. 8424, otherwise known as the ?National Internal Revenue Code of 1997,? by providing that income tax returns of specific taxpayers subject of a request for exchange of information by a foreign tax authority pursuant to an international convention or agreement on tax matters to which the Philippines is a signatory or a party thereof, shall be open to inspection upon order of the President subject to rules and regulations as may be prescribed by the Secretary of Finance, upon the recommendation of the Commissioner of Internal Revenue;

WHEREAS,?with the enactment and approval of RA No. 10021, the government expects to receive numerous requests for exchange of information from foreign tax authorities involving,?inter alia,?income tax returns of specific taxpayers;

WHEREAS,?under the doctrine of qualified political agency, except in cases when the President is required by the Constitution or law to act personally or the exigencies of the situation demand that he acts personally, the multifarious executive and administrative functions of the President are performed by and through the executive departments, and the acts of the Secretaries of such departments, performed and promulgated in the regular course of business, are presumptively the acts of the President;

WHEREAS,?RA No. 10021 does not require that the order to open for inspection of the income tax returns or specific taxpayers subject of a request for exchange of information by a foreign tax authority be done personally by the President; and,

WHEREAS,?to efficiently carry out the purposes and objectives of RA No. 10021 and in order for the President to attend to more urgent and pressing concerns of the nation, there is a need to delegate to the Secretary of Finance the authority to order the opening for inspection of the income tax returns of specific taxpayers subject of a request for exchange of information by a foreign tax authority.

NOW, THEREFORE, I, BENIGNO S. AQUINO III,?President of the Philippines, by virtue of the powers vested in me by law, do hereby order:

SECTION 1. Delegated Authority.?The authority to order the opening for inspection of the income tax returns of specific taxpayers subject of a request for exchange of information by a foreign tax authority pursuant to an international convention or agreement on tax matters to which the Philippines is a signatory or party thereof, is hereby delegated to the Secretary of Finance.

SECTION 2. Issuance of Rules.?The specific rules and regulations that shall govern the opening for inspection of income tax returns of specific taxpayers subject of a request for exchange of information by a foreign tax authority shall be issued by the Secretary of Finance, upon the recommendation of the Commissioner of Internal Revenue.

SECTION 3. Use and Confidentiality.?Any information received by a foreign tax authority as a result of the opening for inspection of the income tax returns of specific taxpayers subject of its request shall be treated by the authority as absolutely confidential in nature in the same manner as information obtained by the latter under its laws and regulations and shall be disclosed only to persons or authorities, including courts and administrative bodies, involved in the assessment or collection of, the enforcement or prosecution in respect of, or the determination of appeals in relation to, the taxes covered by such conventions or agreements.

SECTION 4. Separability Clause.?If any provision of this Executive Order is declared invalid or unconstitutional, the other provisions not affected thereby shall remain valid and subsisting.

SECTION 5. Repealing Clause.?All orders, rules, regulations, and issuances, or parts thereof, which are inconsistent with this Executive Order, are hereby repealed, amended, or modified accordingly.

SECTION 6. Effectivity.?This Executive Order shall take effect immediately upon publication in a newspaper of general circulation.
